This legal agreement is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder, including amendments. This record is generated electronically and does not require physical or digital signatures.
These Terms of Use (hereinafter “Terms”) are published in compliance with:
Information Technology (Intermediaries Guidelines) Rules, 2011
Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
Consumer Protection (E-Commerce) Rules, 2020
By accessing or using the Cakesify platform (“Website” or “Platform”), operated by Cakesify Systems Private Limited, having its registered office at I/701, Maravattickal, Meenangadi, Wayanad, Kerala – 673591 (hereinafter “Cakesify,” “we,” “our,” “us”), you agree to comply with and be bound by these Terms and the Privacy Policy, which forms part of these Terms.

1. Scope and Applicability
These Terms apply to:
Customers purchasing cakes or bakery products.
Sellers/Bakers listing and selling products on the Platform.
Any other Users accessing or browsing the Platform.
By using the Platform, you confirm that you are competent to enter into legally binding agreements under applicable Indian laws. Minors may only use the Platform under the supervision of a legal guardian.

2. Platform Overview
Cakesify operates as a technology marketplace connecting home bakers (sellers) and customers.
Cakesify does not sell products directly and does not provide delivery services.
Sellers are solely responsible for:
Product quality, quantity, and safety
Order preparation, packaging, and delivery
Compliance with local laws including FSSAI and GST
Customers can browse and place orders through the Platform. Cakesify facilitates order placement, payments, and communication between Sellers and Customers.

3. Registration and Account
Registration is optional but recommended for order tracking and seller operations.
Customers provide: Name, Email, Phone, Address, City.
Sellers provide: Name, Email, Phone, Address, GST number, FSSAI registration, and other licenses/certifications required by law.
Users must provide authentic and accurate information and update it promptly.
Users are responsible for account confidentiality and must notify Cakesify of unauthorized access.

4. Eligibility
You must be of legal age to form binding contracts.
Minors may use the Platform only under parental/guardian supervision.
Users must comply with all applicable local, state, national, and international laws.

5. Payments
Payments are processed via third-party gateways such as Razorpay, UPI, Credit/Debit Cards, or wallets.
Any payment gateway charges will apply as specified during checkout.
All payments are subject to the Terms and Policies of the payment gateway.
Cakesify does not store full payment credentials; data security is governed by the gateway provider.

6. User Obligations
You agree to:
Provide accurate and up-to-date information.
Use the Platform lawfully and not engage in any activity that harms other Users or the Platform.
Maintain account confidentiality and notify Cakesify of unauthorized access.
Ensure that content you post (reviews, ratings, comments) is truthful and lawful.
Comply with all laws, regulations, and policies governing food safety, advertising, and e-commerce.
Not use the Platform to:
Impersonate others or provide false information
Upload offensive, obscene, or unlawful content
Hack, reverse-engineer, or disrupt the Platform
Violate intellectual property rights of Cakesify or others

7. Seller Responsibilities
Sellers are responsible for:
Product quality, hygiene, and safety
Timely order fulfillment and delivery
Accurate product descriptions and images
Sellers acknowledge that Cakesify:
Only facilitates the transaction
Cannot guarantee product quality or delivery performance
Customers hold Sellers responsible for any defect, discrepancy, or harm caused by products.

8. Customer Responsibilities
Ensure delivery address and contact details are accurate.
Contact Sellers directly for order issues, while Cakesify may assist as a facilitator.
Accept that Cakesify is not responsible for defects, delays, or damages arising from Seller performance.

9. Intellectual Property
All content on the Platform (logos, graphics, designs) is owned by Cakesify or licensed third parties.
Users may not copy, reproduce, or use content without written consent.
Sellers retain ownership of product images/content they upload, but grant Cakesify a license to display and process such content for Platform purposes.

10. Privacy and Data Protection
All data collection and processing are governed by our Privacy Policy.
Cakesify collects only necessary personal data for order processing, account management, and compliance.
Customer data is shared with Sellers only for order fulfillment.
Data is protected using industry-standard security measures.

11. Content Guidelines
Users are responsible for content they upload or share.
Cakesify reserves the right to remove or block content that is misleading, offensive, unlawful, or violates these Terms.
Users indemnify Cakesify against any losses arising from content posted by them.

12. Indemnity
You agree to indemnify and hold harmless Cakesify and its affiliates, directors, officers, and employees from any claims, damages, or losses arising from:
Violation of these Terms
Product defects or misuse
Any unlawful, negligent, or fraudulent activity
Intellectual property infringement

13. Limitation of Liability
To the extent permitted by law:
Cakesify is not liable for indirect, incidental, special, or consequential damages.
Cakesify is not responsible for:
Internet outages or connectivity issues
Incorrect data or incomplete transactions
Product quality or delivery by Sellers
Disputes between Sellers and Customers

14. Termination & Suspension
Cakesify may suspend or terminate User access for violations of these Terms or applicable law.
Users may terminate their accounts at any time by contacting Cakesify.
Suspension or termination does not waive Cakesify’s rights to pursue claims or indemnity.

15. Force Majeure
Cakesify is not liable for delays or failures due to causes beyond its reasonable control, including:
Natural disasters, pandemics, or acts of God
War, terrorism, riots, labor disputes
Internet outages, technical failures, or hacking

16. Dispute Resolution
Mediation: Attempted first via Centre for Online Resolution of Disputes (CORD) for 45 days.
Arbitration: If mediation fails, disputes will be resolved under CORD Arbitration Rules, seat in Wayanad, Kerala, India, language English.
Governed by Indian law.

17. Miscellaneous
Entire Agreement: These Terms and the Privacy Policy are the complete agreement between Users and Cakesify.
Severability: If a provision is invalid, the rest remain enforceable.
Waiver: Failure to enforce a provision does not waive Cakesify’s rights.
